1. Who we are
These Terms & Conditions (“Terms”) govern use of services offered by Smart Education (“we”, “us”, “our”), based in Zomba, Malawi, Malawi. By creating an account or using our website, portal, Android app, credit wallet, or AI tools, you agree to these Terms.
2. Our services
We may provide:
- Live e-learning classes and period passes
- Paid digital tools such as the AI Exam Generator, charged from account credits
- School websites and related digital presence tools
- Student, teacher, and guardian portals
- A free Android app for supported access
- Administration and communication tools
- Further learning tools as we release them, such as notes and a question bank
3. Accounts and eligibility
You must provide accurate registration details and keep your login secure. You are responsible for activity under your account. School administrators remain responsible for how school data and learner information are used within their institution.
4. Credits, pricing, and payments
Some services deduct credits from your Smart Education balance. Prices are shown before you confirm a paid action. Credits are deducted only after a successful service run (for example, a successfully generated exam file). Unused credits remain on your account unless otherwise stated.
Where mobile money or other payment channels (including future PayChangu top-ups) are offered, successful payment confirmation is required before credits are added. We do not promise cashbacks, refunds for completed digital generations, or compensation for dissatisfaction with AI drafting quality, except where Malawi consumer law requires otherwise or we agree in writing.
5. AI Exam Generator — important notice
The AI Exam Generator may combine approved question-bank items with AI-generated content. AI can make mistakes, invent details, or produce incomplete answers. This tool is recommended for teachers and qualified educators who can check, edit, and approve papers before classroom or assessment use.
You agree that:
- You will review every generated exam and answer key before use
- You will not rely on AI output as a final exam without human verification
- Smart Education is not liable for exam errors that were not corrected before use
- Generated files are for your lawful educational use and must respect school and national assessment rules
6. Acceptable use
You must not use our services to:
- Break Malawi law or school regulations
- Harass, defraud, or mislead learners, guardians, or institutions
- Attempt to reverse-engineer, overload, or abuse our systems
- Upload unlawful, infringing, or harmful content
7. Data and privacy
We process account and service data to provide and improve our platform. Schools using portals remain responsible for lawful handling of learner information. Contact info@smarteducationmw.com for data requests related to your account.
8. Intellectual property
Our branding, software, and platform content belong to Smart Education or its licensors. Question-bank items and generated documents are licensed to you for educational use under these Terms. You may edit downloaded Word exams offline for your school’s needs.
9. Service availability
We aim for reliable service but do not guarantee uninterrupted access. Maintenance, network issues, or third-party AI/payment providers may affect availability.
10. Limitation of liability
To the fullest extent permitted by Malawi law, we are not liable for indirect or consequential losses, including lost marks, exam administration problems, or school operational losses arising from use of AI-generated content that was not properly reviewed. Nothing in these Terms excludes liability that cannot lawfully be excluded.
11. Governing law
These Terms are governed by the laws of the Republic of Malawi. Disputes should first be raised with us in good faith. Courts of Malawi have jurisdiction where formal proceedings are required.
12. Changes
We may update these Terms to reflect new features or legal requirements. Continued use after updates means you accept the revised Terms.
